The following Code of Conduct (“Code”) forms an integral part of the THE EVOLUTION BINARY Participation Agreement. Every Participant, Member, Networker, Agent, or Representative (“Member”) is legally bound to follow these rules. Violation of any rule may result in suspension, termination, removal of benefits, penalties, or legal action under applicable laws.

1. Exclusivity & Non-Compete (Legally Safe Version)

  • Members may not promote, advertise, or solicit participation in any other MLM-based earning system to Evolution BINARY members during their active partnership period.
  • Members are free to join other businesses personally but cannot cross-promote inside Evolution BINARY channels.
  • Any breach may lead to suspension or removal according to internal policy.

2. Anti-Solicitation Rule

  • Members are strictly prohibited from inviting Evolution BINARY members into any external investment, earning, or networking platform.
  • The Company may issue warnings, restrict accounts, apply penalties, or delete the member's account and team accounts without prior warning.

3. Official Meetings Protocol

  • Zoom meetings, webinars, and presentations will be held only during official timings.
  • Members must follow official procedures and instructions during meetings.

4. Question & Answer Policy

  • No open Q&A in meetings where new clients or guests are present.
  • Q&A is allowed:
    • One-on-one with an authorized representative; or
    • In a group after official approval.

5. Financial Transaction Responsibility

The Company is not responsible for losses resulting from:

  • Member-to-member payments;
  • Hand-to-hand money exchanges;
  • Transactions conducted outside the official system.

Only deposits and withdrawals made through official platforms are recognized.

6. Unauthorized Collection of Funds

  • No member is allowed to collect investment amounts from any person.
  • Violation may result in immediate action, including termination and account deletion.

7. Misrepresentation & False Promises

  • Members must describe the system only according to the official plan and procedures.
  • False explanations or personal promises will not be recognized.
  • The Member making false claims will be personally responsible for such claims.

8. Consent to Terms

  • Anyone who disagrees with the system rules is advised not to join.
  • Participation in the system means full acceptance of these rules.

9. Communication Restrictions

  • Members may not contact system management directly without authorization.
  • Communication must be conducted through official representatives and support channels.
  • Any complaint must be submitted through the official system support center. Complaints submitted through unauthorized channels may not be entertained and may be considered a violation of system rules.

10. Anti-Harassment & Anti-Blackmail Rule

  • No member may harass, threaten, force, or blackmail any representative or official.
  • Such actions may lead to termination, deletion of the member's ID and team IDs, and possible legal consequences.

11. Prohibited Topics

  • Political, religious, controversial, or irrelevant discussions are prohibited within official system channels.
  • Violations may result in warnings, removal, or account deletion.

12. Anti-Defamation Clause

  • Members may not knowingly spread false information or intentionally harm the reputation of the System.
  • The System may take disciplinary or legal action where applicable.

13. No Right to Demand Extra Benefits

  • Members may not demand bonuses, compensation, or guarantees outside the official plan.
  • All benefits are system-generated based on eligibility and applicable rules.

14. System’s Right to Modify Policies

  • The System may revise or modify algorithms, plans, policies, or bonuses from time to time.
  • Members are required to comply with updated policies as applicable.

15. Recovery & Adjustments Policy

  • If temporary benefits or financial support were provided and are not returned, the Company may recover the amount from the Member’s account or, where permitted by applicable system rules, make appropriate adjustments involving relevant accounts.
  • Such adjustments are considered internal accounting actions of the System.

16. Compliance with International & Local Laws

  • Members must follow all applicable digital commerce, cybersecurity, and financial governance rules.
  • Violations may result in account suspension, termination, or deletion.
  • The System reserves all legal rights and remedies available under applicable law.

FINAL DECLARATION

  • The Member confirms that they have read and understood this Code of Conduct.
  • The Member voluntarily accepts all applicable rules.
  • Violations may lead to disciplinary action, suspension, termination, deletion, or legal action where applicable.
  • Participation automatically binds the Member to this Code of Conduct and the Terms and Conditions of THE EVOLUTION BINARY.

THE EVOLUTION BINARY

Global Non-Liability, Participation & Risk Acknowledgment Agreement

(For Members, Networkers, Agents, and Participants)

Under Applicable Cryptocurrency and Digital Commerce Laws

1. Parties

This Agreement (“Agreement”) is made between:

THE EVOLUTION BINARY, an online crypto-based earning and networking system,

and

The Participant, who registers, deposits, invests, or participates in the System, plans, or activities.

2. Purpose

This Agreement defines the terms under which the Participant voluntarily participates in THE EVOLUTION BINARY system, acknowledges associated financial and operational risks, and agrees to the limitations of liability described in this Agreement.

3. Acknowledgment of Risk

  1. Cryptocurrency-based earnings and blockchain operations are speculative and subject to market volatility, system algorithms, and digital fluctuations.
  2. The Participant assumes responsibility for all profits and losses associated with their participation.
  3. No guarantee of profit, stability, or continuity is made.
  4. I acknowledge that cryptocurrency-based platforms are risky because crypto markets are highly volatile. I am participating by my own will and accept responsibility for potential losses.

4. THE EVOLUTION BINARY EARNINGS PROTOCOL

  1. Deleted accounts may lose access to system benefits and may not be eligible for refunds or benefits, subject to applicable law and the official system policies.
  2. THE EVOLUTION BINARY operates according to its official marketing and earning plan. I, the Member, acknowledge and understand that after activation of my account, I may create my team, and rewards may be provided according to the applicable system marketing plan and eligibility requirements.

5. Deposits, Claims & Recovery

Deposits and participation contributions are subject to the official system terms, applicable laws, and the specific terms applicable to the relevant transaction.

6. Limitation of Liability

  1. THE EVOLUTION BINARY, its management, representatives, and affiliates are not liable for losses except to the extent liability cannot lawfully be excluded under applicable law.
  2. The Participant agrees to follow the applicable dispute-resolution process and legal procedures set out in the Agreement and applicable law.
  3. Knowingly false, malicious, or retaliatory claims may constitute a breach of this Agreement where legally established.

7. Indemnity

The Participant agrees, to the extent permitted by applicable law, to indemnify and hold harmless THE EVOLUTION BINARY from claims, losses, or expenses arising from the Participant’s own unlawful actions, misrepresentations, or violations of the applicable terms and conditions.

8. Global Legal Compliance

  1. This Agreement shall be interpreted in accordance with applicable cryptocurrency and digital commerce laws.
  2. The Company operates independently and is not a licensed financial institution unless expressly stated otherwise.
  3. Disputes may be resolved through the applicable dispute-resolution and arbitration procedures provided in the Company's official terms and applicable law.

9. Electronic Signature & Global Validity

  1. Electronic acceptance may be legally recognized under applicable electronic transaction and electronic signature laws, subject to the laws applicable to the Participant and the transaction.
  2. Deposit confirmation, identity verification, OTP verification, and online acceptance may constitute electronic acceptance of the applicable agreement where legally recognized.
  3. This Agreement may become effective upon successful acceptance and confirmation according to the System’s official procedures.

10. Dispute Resolution

I voluntarily joined THE EVOLUTION BINARY and understand the earning model, risks, terms, and conditions applicable to my participation.

I agree to use the official complaint and dispute-resolution procedures provided by the System and applicable law. Nothing in this Agreement shall be interpreted as removing any mandatory legal rights or remedies that cannot lawfully be waived.
